Terms of Service and Liability Disclaimer
These Terms of Service and Liability Disclaimer ("Agreement") govern the mobile vehicle inspection, buyer advocacy, and negotiation services ("Services") provided to you ("Client," "you," or "your"). By engaging these Services, you acknowledge that you have read, understood, and agreed to the following terms.
1. Scope of Services
The Services consist of a non-invasive, visual-only inspection of a specified motor vehicle, a standard OBD2 electronic diagnostic scan, and optional buyer advocacy and negotiation on your behalf. The purpose of these Services is to provide an educated, experienced assessment of the vehicle's general cosmetic and observable condition at the time of inspection to assist you in your purchasing decision.
2. Nature of the Inspection
Please read carefully: The inspector possesses extensive automotive experience but is not a qualified, licensed, or certified mechanic.
The inspection is strictly a visual and operational assessment of readily accessible components.
We do not dismantle any part of the vehicle, put the vehicle on a hoist, remove wheels, or conduct internal engine or transmission diagnostics.
This Service is designed to identify obvious visual defects, poor repair work, and apparent cosmetic or operational issues. It is not a substitute for a comprehensive mechanical, roadworthy, or structural inspection conducted by a licensed mechanical workshop.
3. Limitations of Liability and Unforeseeable Defects
Vehicles are complex machines subject to wear and tear, and components can fail without warning.
We cannot predict, foresee, or guarantee the future performance, reliability, or lifespan of the vehicle or any of its components.
We accept no liability for hidden, concealed, or intermittent defects that are not immediately apparent during a standard visual inspection and brief test drive (e.g., internal engine damage, slow fluid leaks, impending transmission failure, or water ingress).
The Client agrees to hold the inspector harmless from any claims, losses, damages, or expenses arising from the purchase or subsequent failure of the inspected vehicle.
4. OBD2 Diagnostic Scans
The Service includes plugging an OBD2 diagnostic reader into the vehicle's onboard computer to check for active or stored fault codes.
An OBD2 scan is not foolproof. Unscrupulous sellers can clear fault codes shortly before an inspection.
A "clean" scan (no codes found) does not guarantee the vehicle is free of electronic or mechanical faults, nor does it guarantee that the check engine light will not illuminate in the future.
5. Buyer Advocacy and Negotiation
If you engage our Services to negotiate with a private seller or dealership on your behalf:
We will act in your best interest to secure a fair price and favourable terms based on current market conditions and the vehicle's inspected condition.
We do not guarantee a specific purchase price, discount, or successful transaction.
The final decision to purchase the vehicle, sign any contracts, and transfer funds rests entirely with the Client. We are not a party to the vehicle purchase contract.
6. Safety and Test Drives
Test drives are conducted strictly at the discretion of the inspector and the vehicle's vendor. If the vehicle is deemed unsafe to drive, lacks registration, or if the vendor refuses to allow a test drive, this portion of the inspection will be omitted, and no refund will be provided for this omission.
7. Governing Law
This Agreement is governed by the laws of Victoria, Australia. Any disputes arising out of these Services shall be subject to the exclusive jurisdiction of the courts of Victoria. By proceeding with the booking, you acknowledge that your consumer rights are governed by Australian Consumer Law, and nothing in this disclaimer is intended to restrict, modify, or exclude those non-excludable rights.
Client Acknowledgement: By booking an inspection or authorising negotiation services, I acknowledge that I have read and agree to these Terms of Service. I understand that the inspector is an experienced automotive advocate, not a qualified mechanic, and that the final decision and financial responsibility for purchasing the vehicle remain entirely mine.
